This privacy notice relates to the personal data processed by Stuart Black, Surrey Heath Borough Councillor for Frimley Green, in relation to casework, enquiries and mailing list susbcriptions.

Who are we?

Stuart Black is the data controller.

Stuart Black may be supported by others to collect and process data on his behalf.

In order to discharge the duties of an elected Counsellor, Stuart Black will conduct resident casework, conduct resident surveys and respond to enquiries, for which he must process personal data of residents.

What personal data will you collect and process?

The personal data we collect and process on you may include name, address, , email, telephone numbers, government or 2rd party references (e.g electoral roll number).

Special category data will be processed under the lawful basis indicated in section 3, as is permitted in clauses 22, 23 and 24 of schedule 1 of the Data Protection Act, covering political parties and elected representatives.

How do we process data?

Our primary legal basis for processing personal data is legitimate interest necessity in performance of a public task vested in Stuart Black, i.e. as a SHBC Councillor.

In instances where this lawful basis is not sufficient and explicit consent is required, we will seek your consent.
In any event, we are committed to ensuring that the information we collect and use is appropriate for this purpose and does not constitute an invasion of your privacy.

Will we share your data with anyone else?

The main recipients of this data will be Stuart Black, anyone who acts on Stuart Black’s behalf in exercising his functions as a Councillor, and anyone who assists him in future election campaigns.

In exercising the role of a SHBC Councillor, it may be necessary to pass on your personal data to third parties to assist with your enquiry. Examples are Surrey County Council, Surrey County Council Councillors, and the office of our Member of Parliament.

Data Retention

This data will be retained until the resident asks for it to be removed or Stuart Black is no longer a Councillor.

Data Security

Data will be secured by password protection on computers or lockable physical storage.

Your rights as a data subject

While we are in in possession of or processing your personal data, you, the data subject, have the following rights:
• Right of access – you have the right to request a copy of the information that we hold about you.
• Right of rectification– you have a right to correct data that we hold about you that is inaccurate or incomplete.
• Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.
• Right to restriction of processing – where certain conditions apply to have a right to restrict processing.
• Right of portability – you have the right to have the data we hold about you transferred to another organisation.
• Right to object – you have the right to object to certain types of processing.
• Right to object to automated processing, including profiling – you also have the right to be subject to the legal effected of automated processing or profiling.

Complaints

If you are unhappy with the way that we have processed or handled your data then you have a right to complain to the Information Commissioners Office (ICO).

Note that since April 2019, the Data Protection (Charges and Information) (Amendment) Regulations 2019 exempted the processing of personal data by elected representatives and prospective representatives.  This means they don’t have to pay a fee to the ICO. The data protection fee replaced the requirement to ‘notify’ (register with) the ICO in 2018, so there will no record of fee payment or registration on the ICO website for those exempted.
